By purchasing or accessing The Designers Orchard membership (the “Program”), you (“Member”) agree to the following terms with The Designers Orchard (“Company,” “we,” “our,” or “us”).

 

PART I — TERMS OF USE
 

1. Membership Overview

The Program is a recurring membership that provides educational content, design tutorials, marketing resources, and ecommerce strategy training.

While your membership is active and in good standing, you will receive access to the materials described on the checkout or sales page at the time of purchase.

All content is educational in nature.

Access to materials is granted only while your membership remains active.

 

2. License & Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Program content for your own business and creative development.

 

You may:

  • Apply the skills and strategies taught to your own designs and products
     
  • Sell finished products you personally create using the knowledge gained
     
  • Use downloadable assets in original end products, if commercial use is expressly stated
     

You may not:

  • Share your login credentials
     
  • Reproduce, copy, or distribute Program tutorials or resources
     
  • Resell or redistribute templates, graphics, downloads, or files as standalone products
     
  • Create MRR (Master Resell Rights), or white-label products from Program materials
     
  • Teach, republish, or present Program content as your own
     

All intellectual property remains the sole property of The Designers Orchard.

 

3. Payment & Billing

By enrolling, you agree to pay the subscription rate in effect at the time of purchase.

You authorize us and/or our third-party processors (such as Stripe, PayPal, or platform providers) to charge your selected payment method on a recurring basis according to your chosen billing cycle.

If a payment fails, access to the Program may be suspended immediately until payment is successfully processed.

If you cancel and later rejoin, you will re-enroll at the current pricing in effect at that time.

 

4. No Refund Policy

Due to the digital nature of the Program and immediate access to proprietary materials, all sales are final. No refunds will be issued.

 

5. Cancellation & Termination

You may cancel your membership at any time.

Upon cancellation, access to the membership portal, all content, downloads, and community areas will terminate at the end of your current billing period (or immediately if payment is delinquent).

We reserve the right to terminate access at any time for violation of these Terms.

 

6. Intellectual Property

All Program materials—including but not limited to text, videos, templates, graphics, branding, frameworks, downloads, and systems—are protected by copyright and other intellectual property laws.

Participation in the Program does not transfer ownership rights to you.

 

No reproduction rights are granted under this Agreement beyond the limited license described above.

 

7. No Guarantees

We provide education, information, and strategy guidance.

 

We do not guarantee:

  • Income levels
     
  • Sales performance
     
  • Business growth
     
  • Platform rankings
     
  • Algorithm results
     

Your results depend on your own efforts, implementation, market conditions, and external platform policies.

 

8. Limitation of Liability

To the fullest extent permitted by law, The Designers Orchard shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of your participation in the Program.

All materials are provided “as is” without warranties of any kind, express or implied.

 

9. External Platforms & Third-Party Links

The Program may reference or link to third-party platforms (including but not limited to Zazzle, Etsy, Adobe, or keyword research tools).

We do not control, endorse, or guarantee the accuracy or reliability of third-party websites, policies, or services.

Use of third-party platforms is at your own risk and subject to their respective terms.

All trademarks and logos referenced remain the property of their respective owners.

 

10. Affiliate Disclosure

The Program may contain affiliate links. If you click on an affiliate link and make a purchase, we may earn a commission at no additional cost to you.

We only recommend tools and services we believe are helpful to creative business owners.

 

11. Testimonials

Testimonials reflect individual experiences. Results vary.

We do not represent that all Members will achieve the same outcomes.

 

12. Indemnification

You agree to indemnify and hold harmless The Designers Orchard from any claims, damages, liabilities, or expenses arising from:

  • Misuse of Program materials
     
  • Violation of these Terms
     
  • Violation of third-party rights
     
  • Violation of applicable laws
     

13. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, technological failures, internet outages, or governmental actions.

 

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Kentucky.

Any disputes arising from this Agreement shall be resolved in the courts located in Daviess County, Kentucky.

 

15. Modifications

We reserve the right to update these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date.

Continued participation constitutes acceptance of the revised Terms.

 

PART II — PRIVACY POLICY
 

1. Information We May Collect

  • We collect only the information necessary to operate the membership, including:
